Greetings from Team WholeHearted!

WholeHearted is a pro-bono student initiative dedicated to providing legal and personal support to the single father community in Hong Kong. We won the 2022 PILnet Law For Change Student Competition, successfully implemented a food pack service scheme for single fathers in Hong Kong, and produced legal publications on various family law issues in 2023.

Recently, we had the opportunity to help with the insightful talk ”平衡與責任：探視與贍養費的兩難“ (Balance and Responsibility: The Dilemma of Access and Alimony) organized by 親和坊！Here’s a quick recap of what was covered:

🔎What is Best Interest of the Child 👧🏻👦🏻?

Best interest of the child is a legal standard used when two parents are contesting custody of their child. This concept is extracted from the United Nations Convention on the Rights of the Child, which recognizes that in all actions concerning children, their best interests shall be the primary consideration. Courts use this doctrine to make decisions regarding which parent will have custody, the nature and extent of visitation rights, and child support obligations. This can ensure the child’s physical and psychological well-being are protected and prioritized over parents’ interests.

In practice, there is no hard and fast rule to determine the exact meaning of best interest of children. It often involves balancing various factors, and the importance of each factor can vary from case to case.

Both the UK and Australia have created a statutory list of factors that should be considered when deciding what is best for a child. Hong Kong Courts adopted the UK checklist in 2006 and has used it since.

Non-exhaustive list of factors:
● The child’s health and emotional well-being
● The child’s thoughts and desires (unless they are inappropriate to be taken into account)
● The child’s needs (e.g. the necessity for stability appropriate to their age and developmental stage)
● The child’s age, maturity, sex, cultural identity and language.
● The history of who has cared for the child and the quality of that care.
● The capability of a parent to meet the needs of the child
● Any instances of family violence and their impact on the child

🔎What is Best Interest of the Child 👧🏻👦🏻?

Mental Health Challenges Faced by Single Fathers

🏆 Emotional and psychological challenges
A research conducted in 2015 concluded that single parents in Germany are more likely to develop symptoms of depression and anxiety than that of partnered parents since they had to perform multiple roles in the family, e.g. managing household chores while ensuring a stable financial status. Criticisms, social stereotypes and doubts towards single parents may also intensify their stress, leading to loneliness and isolation. In particular, the well-being of single fathers are often neglected by society due to traditional gender stereotypes, with women being the loving caretakers and men as the tough providers. This deters single fathers from seeking help and advice, thus it is crucial to create an inclusive and supportive environment that allows them to express concerns and seek assistance.

🏠 Existing support systems for single fathers
In Hong Kong, a few Integrated Family Service Centres (“IFSCs”) operated by the Social Welfare Department and non-governmental organisations were set up to address single parents’ needs. They aim to promote family unity, identify family problems and provide corresponding early intervention by offering a variety of services. These services are targeted to enhance parenting skills, strengthen parent-child relationships, provide mental health education etc. Moreover, the 65 IFSCs situated in various districts as well as 2 Integrated Services Centres in Tung Chung have handled over 12,000 single-parent family cases from 2015 to 2018.

Two proceedings can be instituted by parties to apply for divorce. The first proceeding is by petition. This is a proceeding that is initiated by a single party. The second is by an application for divorce.

⚠️Custody
When it comes to court judgment, there is a tendency for the court to decide in favour of the mother. If the child is born out of wedlock, the mother will enjoy all the parental rights and authority, unless an application is made by the unmarried father. Otherwise, in cases where the child is born by married couples, the mother and father will enjoy equal rights and authority.

⚠️Parental Alienation
Parental Alienation Syndrome refers to a series of symptoms that children suffer in custody disputes, where the children are actively induced by, usually, the parent that has more contract with them, to hate another parent. Statistics show that 15% of divorce cases that involve children include parental alienation, thus there is a growing tendency for the court to acknowledge parental alienation in divorcing families.

🤝🏻B. Existing channel
Currently, several governmental and non-governmental organisations in Hong Kong aim to help single fathers.

🙌🏻Legal Aid Department
Provides legal representation to eligible applicants by a solicitor or a barrister in proceedings to be heard at most levels of courts. If applicants want to seek legal advice, they have to apply for the Free Legal Advice Scheme by making appointments at any District Office or by referral agencies.

🙌🏻The Law Society of Hong Kong
Offers a list of law firms that are willing to offer an initial free legal consultation for 45 minutes.
In addition, the Law Society of Hong Kong offers a Free Legal Helpline “8200 8002” which provides 45 minutes of free legal consultation, including matrimonial law, or a free telephone session on mediation.

😢Issue 1: Difficulties in Seeking high-skilled jobs
In comparison with 2016, the proportion of single fathers in various sectors have remained more or less the same in 2021. In both years, most working single fathers were engaged in the construction sector, while there was little to no change in the distribution of single fathers in higher-skilled and lower-skilled occupations. As seen, there has been limited improvement in single fathers’ upper-moving opportunity in the past 6 years. It should also be noted that while the median monthly domestic household income of single parents has increased slightly in the past decade, from $10,450 in 2011 to $18,260 in 2021, it is still yet to reach the median of $27,650 for all domestic households. This reveals that single fathers have not been able to significantly raise their income. Thus, what they need is more skills and training to catch up with the market trend and earn more disposable income.

🌟Possible Solution
It is crucial that single fathers are well-informed with the employment support available to them. For example, the Labour Department provides free employment services specifically to part-time job-seekers who are burdened with other tasks such as family care, which single fathers can certainly benefit from. There are part-time job fairs, a dedicated webpage on part-time job vacancies, and employment schemes, such as the Work Trial Scheme. As for training, the Employees Retraining Board aims to provide market-oriented, employment-based training courses that take into account the familial responsibilities of trainees. For example, there are half-day or evening courses, with flexible hours and leave arrangements according to the needs of trainees’ family positions. Through becoming aware of and utilising these avenues of retraining, single fathers may be better equipped to re-enter the labour market or apply for higher-skilled jobs.

In the case of CLP v CSN, it concerns an application for guardianship by a grandmother (applicant). The respondents are the mother (1st respondent) and the father (2nd respondent) of the child who were not represented and did not appear.

According to the applicant, the mother was rebellious and left home when she was 17. One day, she returned home to the applicant when she found herself pregnant with the child, and disclosed that the 2nd respondent was the father of the child. However, the mother had no intention of marrying the 2nd respondent and gave birth to the child at the age of 19. After that, she left home again, leaving the child to the care of the applicant, and has never contacted the applicant or the child since then. The father of the child had equally also disappeared from the scene, and thus neither the mother nor the father had applied for the custody of the child.

The applicant has been the child’s prime carer since birth and has assumed the role of a surrogate mother of the child. Since the applicant is not the child’s guardian, she experienced daily difficulties in arranging for the education and obtaining travel documents for the child, which caused her to make the present application for guardianship.

🔎What is wardship?
Wardship is an urgent application to have a child declared a ward of court. This means that the court makes decisions about the care and control of the child, access arrangements, and the child’s place of residence. The court may also make orders concerning the maintenance, education, religion, and marriage of the child. Meanwhile, the court can assign “care and control” of the ward to an appropriate party.

Who can apply for wardship?🙋
A wide range of individuals, including parents and non-parents are eligible to apply for wardship. Non-parents refer to a variety of classes, such as relatives, fathers of illegitimate children, commissioning parents in surrogacy, or others with a sufficient interest in the child. Wardship is an urgent application to have a child declared a ward of court. This means that the court makes decisions about the care and control of the child, access arrangements, and the child’s place of residence. The court may also make orders concerning the maintenance, education, religion, and marriage of the child. Meanwhile, the court can assign “care and control” of the ward to an appropriate party.

Who can apply for wardship?🙋
A wide range of individuals, including parents and non-parents are eligible to apply for wardship. Non-parents refer to a variety of classes, such as relatives, fathers of illegitimate children, commissioning parents in surrogacy, or others with a sufficient interest in the child. Guardianship refers to the legal status under which a guardian is legally entitled to exercise parental rights and duties in relation to a child. In Hong Kong, the Guardianship of Minors Ordinance (Cap. 13) (‘GMO’) outlines a substantial part of the law concerning guardianship.

🔎There are three ways to become a guardian. First, guardianship could be automatically transferred to the surviving parent. S 5 of the GMO provides that on the death of one parent, the surviving parent will automatically become the guardian of the minor either on his own or jointly with a guardian appointed by the other parent (if there is any). However, if there is a pre-existing court order or deed of guardianship, to the contrary, this rule will not apply. Second, guardianship could be obtained through appointment by a parent or a guardian. S 6 of the GMO provides power to a parent or a guardian to appoint a guardian in the event of their death. 🔎 What is Access?🌟

Access refers to the right of the children to see the non-custodial parent, or in the case of joint custody, the right of the child to see the parent without care and control. Normally, the court will grant an order of reasonable access to the non-custodial parent and the details are left for the parents to decide with each other. Otherwise, the court can make an order for defined access, where the time, and sometimes place, of the access is specified in the court order.

✍🏻 Void and Voidable Marriage ⛪

When a marriage is void, both parties are considered to have never wedded. As for voidable marriage, before further declaration of nullity from the Court, it is still valid in the legal sense and the marital relationship subsists.

There are 4 grounds for void marriage, and they can all be found in s.20(1) of the Matrimonial Causes Ordinance (Cap. 179) (MCO). Meeting any of the conditions can already nullify a marriage.

First, the marriage in question does not conform with the definition of a “valid marriage” under s.27 of the Marriage Ordinance (Cap. 181). This occurs when parties to the marriage are within the prohibited degrees of kindred or affinity, like adoptive parents, grandparents, parents and siblings. The complete list is included in Schedule 5 of the Marriage Ordinance (Cap. 181). Marriage is also invalid where either party is under the age of 16, or when the parties have intermarried disregarding requirements for marriage. The second and the third grounds target Chinese customary marriage and unions of concubinage which were abolished in 1971, as they expressly forbid bigamy and marriages invalid by the law of Hong Kong. Additionally, same-sex unions are void in the fourth ground. Hong Kong has yet to legalize same-sex marriage, and thus it is still bound by the Corbett v Corbett decision, in which parties to the marriage must be male and female respectively.

On the other hand, there are 6 grounds for voidable marriage, which are listed under s.20(2) of the MCO. Same as void marriage, fulfilling any of the grounds will be sufficient.

Care and Control refers to the mundane, day-to-day care of the child, e.g., what they eat, what they wear and when to sleep. The parent who has the right of care and control will have the duty to supervise the daily life of the child and provide residence arrangements.

Apart from sole care and control, there could also be joint or shared care and control.

For both joint and shared care and control, the child will spend significant periods of time with both parents in each of their homes (not necessarily on a 50:50 basis but at least 35% of his/her time with each of his/her parents).

The main difference between the two forms of care and control is that in joint care and control, the parents have a higher level of cooperation. The court does not need to set out clearly how the child spends his/her time while in shared care and control, the parents usually could not cooperate with each other. Thus, the court has to set out the period of time for each parent to take care of their child clearly.

🔎 What is Maintenance? 💰

Maintenance, or named as Alimony in the US, refers to the payment from one party to another party to the marriage after a divorce. The aim of the maintenance is to enable the other party to pay for the living expenses of himself or herself or any child of the family. Divorcing parties could either decide the amount on their own or seek a maintenance order from the court.

Maintenance can be divided into spousal maintenance and child maintenance. Spousal maintenance refers to the maintenance for the benefit of the husband or wife. s7(1) of the Matrimonial Proceedings and Property Ordinance lists out factors assessing the maintenance fee.

Child maintenance refers to the maintenance for the benefit of the child of the family. s7(2) of the Matrimonial Proceedings and Property Ordinance lists out the factors assessing the maintenance fee.

In Hong Kong, single fathers make up a certain percentage of the single-parent population, with a growing need of support and resources. According to the statistics from 2021 Population By-census, around 22.2% of single parents in Hong Kong are single fathers, and they are taking care of around one fifth of the dependent children. The average number of dependent children per single fathers is 1.2.

Compared to Ontario, Canada, the proportion of male lone families also reached 20%. While Canada has been taking comprehensive Federal Family Assistance Programs initiatives to provide aid and resources to these families, there is still a lack of support to the single father community in Hong Kong.
